Terms and Conditions

1. Scope of Services

Better Business Staffing agrees to provide staffing services to client companies for temporary, direct hire, and project-based employment needs. These services include candidate recruitment, screening, interviewing, and placement.

2. Engagement Process

Client companies will submit job requirements to Better Business Staffing. The staffing agency will then present qualified candidates for consideration. Upon client approval, Better Business Staffing will facilitate the hiring process.

3. Fees and Payment:

Temporary Placement: Clients agree to pay a predetermined hourly rate for each temporary employee. Invoicing will occur on a weekly basis, and payment is due within 15 days of the invoice date.
Direct Hire Placement: A one-time fee, based on a percentage of the candidate's first-year salary, is applicable for direct hire placements. Payment is due within 30 days of the candidate's start date.
Project-based Placement: Fees for project-based work will be outlined in the project contract. Payment terms will be agreed upon before the commencement of the project.

4. Candidate Guarantee:

Better Business Staffing provides a guarantee period for direct hire placements. If a candidate leaves the position or is terminated within the guarantee period, the staffing agency will provide a replacement candidate at no additional cost or refund a prorated portion of the placement fee.

5. Confidentiality

Both parties agree to keep all confidential information, including but not limited to business strategies, candidate information, and client requirements, confidential and not disclose such information to third parties without written consent.

6. Termination

Either party may terminate the agreement with written notice. Termination does not relieve the client of the obligation to pay for services rendered prior to the termination date.

7. Compliance with Laws

Better Business Staffing agrees to comply with all applicable federal, state, and local employment laws and regulations. The client agrees to provide a workplace free from discrimination and harassment.

8. Insurance

Better Business Staffing carries appropriate insurance coverage, including workers’ compensation, liability and professional insurance, to cover its employees while on assignment.

9. Indemnification

The client agrees to indemnify and hold Better Business Staffing harmless from any claims, liabilities, damages, or expenses arising out of the client’s use of staffing agency services.

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Better Business Staffing is located.

By engaging in services with Better Business Staffing, both parties agree to abide by these terms and conditions. Any modifications or amendments to this agreement must be in writing and signed by both parties.
